Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by Pooria Zamani ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not access or use our services.

2. Scope of Work & Fixed Deliverables

We build high-performance web infrastructure, custom startup landing pages, and digital presentation solutions.

The project scope is strictly defined by the approved wireframe and layout features agreed upon before the kickoff. Any feature, section, or functionality requested outside this initial scope will be treated as an Add-on and invoiced separately.

3. Included Revisions (Max 2 Rounds)

We include a maximum of two (2) rounds of revisions during the feedback phase:

• Round 1: Comprehensive feedback on the initial design/layout.
• Round 2: Minor adjustments and final polish based on the first round's updates.

All feedback must be compiled and sent in a single, organized list per round.

4. Post-Revision & Hourly Rate

Any additional change, tweak, or revision requested after the 2nd round is completed will be charged at a flat rate of €50 per hour. Work on these additional requests will only begin once the hourly estimate is approved by the client.

5. Client Obligations

To ensure rapid and high-quality delivery, the client agrees to provide all necessary assets, copy, logos, feedback, and access permissions in a timely manner. We are not responsible for delays caused by incomplete or late provisions of materials from the client.

6. Intellectual Property

Unless otherwise specified in a signed project agreement, all custom source code, designs, and content created specifically for your project will be transferred to you upon full payment. Any third-party libraries, pre-existing proprietary frameworks, or assets used remain the property of their respective owners.

7. Payment and Cancellation

Payment terms are established on a per-project basis. Typically, a deposit is required before work commences. Once development starts, the deposit is non-refundable. Remaining balances must be cleared in accordance with agreed milestones or upon completion before project transfer.

8. Limitation of Liability

In no event shall Pooria Zamani be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of our services or websites.

9. Governing Law

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands.
